PERSONAL DATA PROTECTION NOTICE
This Personal Data Protection Notice (“Notice”) describes how AGENSI PEKERJAAN TECH STAFFING SDN. BHD. (a company incorporated under the Malaysian Companies Act 2016 with its place of business at Level 15.01, 1 First Avenue, 2A, Dataran Bandar Utama, 47800 Petaling Jaya, Selangor) (“Company”) uses your Personal Data.
In general, by engaging and continue to engage the Company as your agents, or by providing personal data to the Company via emails, messages through social applications and/or the Company’s website, www.techstaffing.my (“Website”), you consent to the Company’s processing of your personal data by the Company and all persons involved in the provision of services as a private employment agency, and as necessary to comply with the Company’s obligations as prescribed by applicable laws.
The Company reserves the right to modify or amend the terms of this Notice from time to time by placing the updated Notice on our Website. By continuing to communicate with the Company or by continuing to use the Company’s services following the modifications, updates or amendments to this Notice shall signify your acceptance of such modifications, updates or amendments.
1. Collection of Personal Data
1.1 For the purposes of the Company’s engagement by you, you have provided to us the following data:-
(a) Personal information such as your name, address and/or location, telephone number, email address, or any information related to you; and (b) Employment information which may include your resume, Linkedin Profile URL, profession and/or occupation, prior remuneration details, work email, company employment details, employment history and any other pertinent employment-related information;
(collectively referred to as “Personal Data”) which will be collected, recorded, held, stored and processed by us, the Company, including our employees, to be utilized and dealt with in accordance and in compliance with the Personal Data Protection Act 2010.
1.2 In addition to the Personal Data, you provide to the Company directly, the Company may also collect your Personal Data from a variety of sources including but not limited to, from online search tools, information obtained from third parties through regulatory and government authorities, or at events organised or participated by us, the Company. Although the Company monitors the information on our Website, some of the information is supplied by independent third parties. While the Company makes every effort to ensure the accuracy of all information on our Website, the Company makes no warranty as to the accuracy of any such information.
1.3 Typically, we do not need to collect any sensitive information when you engage with us. Please exercise caution and only disclose such information when required, especially when completing a job application as a user/candidate. Sensitive information will only be collected on behalf of advertisers, employers and/or recruiters under the following circumstances:-
(a) You voluntarily include it in your documents or profiles during a job application.
(b) You explicitly permit our third-party verification provider to share it with us.
(c) You furnish to us upon successful placement of employment.
(d) You have provided consent for the purpose of submitting reports to regulatory and government authorities.
(e) There’s a legal basis for its collection.
1.4 The provision of your Personal Data is voluntary. However, if you do not provide your Personal Data, the Company may not be able to (i) communicate with you; (ii) provide you the services you require or (iii) access certain sections of our Website where log in required. In respect of Personal Data of third parties such as your spouse and family members, you warrant that you have obtained their consent to allow us to process their Personal Data.
2. Purposes of Processing
The Company may use and process the Personal Data for the purposes relating to the services you have requested and for the business activities of the Company which shall include, without limitation:-
(a) for internal administrative purposes and record keeping of all matters including historical and conflict checking purposes;

and you agree and consent to the Company using and processing your Personal Data in the manner as identified in this Notice.
3. Transfer of Personal Data
If the Company’s information technology storage facilities and servers may be located in other jurisdictions, your Personal Data may be transferred to, stored, used and processed in a jurisdiction other than Malaysia. Further, your personal data may be transferred out of Malaysia for the purposes as may described in writing by the Company, and you understand and consent to the transfer of your Personal Data out of Malaysia as described herein.

(f) International Organization for Standardization (ISO) Certification bodies along with their management, employees, consultants, entities, and personnel authorised within the organization in accordance with ISO standard implementation;

(i) government agencies, statutory authorities, industry regulators and other similar authorities;
(j) regulatory and governmental authorities in order to comply with statutory and government requirements;
(k) any person to whom we are compelled or required to do so under the law or in relation to any order or judgment of a court;
(l) in the event of any merger, acquisition or restructure, the transferee or successor of any entity within the Company, or any prospective purchaser of any business or asset within the Company (together with its relevant advisors). and
(m) as otherwise permitted under Malaysian law, including but not limited to, the Personal Data Protection Act 2010

Upon expiry of the retention period, your personal data will be securely disposed of in accordance with our data retention policies. The retention period may vary for inactive Personal Data depending on the nature and the purposes for which it was collected, but it will not exceed the duration permitted by the Personal Data Protection Act 2010 or any other applicable laws and regulations.

Further, you may communicate to us in written form to our Data Protection Officer at our contact details below pertaining your objection to the use of your Personal Data for any purpose whatsoever and/or your withdrawal, in full or in part, of your consent given herein.
9. Inaccurate Data
The Company and its management, employees, authorised officers, or agents will not be responsible for any personal data submitted by you to us that is inaccurate, misleading, incomplete or not updated, or entered into our system incorrectly due to human error.
